Terms of Service

1. Acceptance of Terms

By accessing or using Instalen ("Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Instalen is a read-only Instagram analytics platform that connects to your Instagram Business or Creator Account via the Meta Graph API to provide engagement insights, viral pattern detection, best posting time analysis, and AI-powered content suggestions.

3. Eligibility and Age Requirements

To use Instalen you must:

• Be at least 13 years of age. Instalen is not directed at children under 13.
• Be at least the minimum age required in your country to consent to data processing (16 in most EU member states; varies by jurisdiction).
• Have a valid Instagram Business or Creator Account and comply with Meta's Platform Terms.

If you are between 13 and 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly provide services to minors without verifiable parental consent where required by law.

4. Consent to Data Processing

By clicking "Continue to Instagram" on the connect screen, you explicitly consent to Instalen accessing, storing, and processing your Instagram account data as described in our Privacy Policy. You may revoke this consent at any time by disconnecting your account in Settings.

5. Your Account

You are responsible for maintaining the security of your account. Instalen will never post, like, comment, follow, or take any action on your Instagram account. We only read data — we never write to it.

6. Acceptable Use

You agree not to:

• Use Instalen for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to reverse-engineer, scrape, or systematically extract data from the Service
• Share your account credentials with others or allow unauthorized access to your account
• Use the Service in a way that violates Meta's Platform Policies or Instagram's Terms of Use
• Abuse the AI generation features in a way that incurs excessive cost (rate limits apply)

7. Subscription and Billing

Paid plans are billed monthly through Stripe. By subscribing you authorize Stripe to charge your payment method on a recurring basis. Subscriptions auto-renew unless cancelled before the renewal date.

Refunds are handled on a case-by-case basis. Contact mayank@zapmedia.cc within 7 days of a charge if you believe it was made in error.

8. Intellectual Property

All content, design, and code within Instalen is owned by Instalen / ZapMedia CC. Your Instagram data remains yours — we claim no ownership over it. AI-generated suggestions are provided as tools for your use and are not proprietary to Instalen.

9. Disclaimer of Warranties

Instalen is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or that analytics insights will result in account growth. Use of AI-generated suggestions is at your own discretion.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Instalen shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including any loss of data, revenue, or profits. Our aggregate liability for direct damages shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Termination

You may stop using Instalen at any time and disconnect your account from the Settings page. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Instalen operates, without regard to conflict of law principles.

For EU/EEA users: Nothing in these Terms affects your rights under applicable consumer protection laws, including your right to bring a claim before your local courts or an alternative dispute resolution body. For any disputes, please first contact us at mayank@zapmedia.cc to attempt resolution informally.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a dashboard notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
